Question 1
I have a medical degree and an additional MD qualification in Obstetrics and Gynecology, both from a medical university in Tamil Nadu, and I am registered in the Tamil Nadu Medical Council. If I travel to another state for a medical camp, will I be able to conduct a surgery there?
Answer
When a person is registered with the Medical Council of India, he or she is legally permitted to practice anywhere in the country. The following sections of the Indian Medical Council Act should clarify this issue:
Section 27 of the Indian Medical Council Act:
Privileges of persons who are enrolled on the Indian Medical Register:
Every person whose name is being borne on the Indian Medical Register shall be entitled according to his/her qualifications to practice as a medical practitioner in any part of India, and to recover in due course of law in respect of such practice, any expenses, charges in respect of medicaments or other appliances, or any fees to which he/she may be entitled.
Section 28 of the Indian Medical Council Act:
Person enrolled on the Indian Medical Register should notify change of place of residence or practice within thirty days of transfer.
In short, if you are enrolled in the Indian Medical Register, you have the privilege to practice anywhere in the country and also collect remuneration for the same. Your registration with the Medical Council of a particular state does not prevent you from going to another state on a temporary basis. If however, you are changing your place of residence to another state (e.g. joining a hospital in another state), you must register with the Medical Council of that particular state within a month of changing your residence.
